In its resolution of 05.04.2007, the Federal Arbitration Court of the Moscow Circuit upheld the ruling of the Arbitration Court of the City of Moscow of 18.12.2006, that acknowledged as invalid the decision of the Inspectorate of the Federal Service for Taxes and Collections of Russia № 28 for the City of Moscow of 24.07.2006 № 386, concerning the refusal to bring to tax liability for a tax offence committed.

In its resolution of 22.03.2007, the Federal Arbitration Court of the Moscow Circuit upheld the ruling of the Arbitration Court of the City of Moscow of 31.08.2006 and the resolution of the Ninth Arbitration Appeals Court of 22.11.2006, as well as the supplementary ruling of the Arbitration Court of the City of Moscow of 16.10.2006 and the resolution of the Ninth Arbitration Appeals Court of 29.12.2006, acknowledging as invalid the decision of the Inspectorate of the Federal Tax Service of Russia № 7 for the City of Moscow of 15.11.2005 № 287 concerning a total dismissal of claims for the return of the sum of value added tax.

The Commission of the Federal Antimonopoly Service (FAS of Russia) declared the actions of LLC “Star Glass Lighting”, resulting in the acquisition and use of exclusive rights to a trademark, to be unfair competition.

The Commission of the FAS of Russia considered the case of violation of antimonopoly legislation № 514/480-06 and found that the actions of LLC “Star Glass Lighting”, connected with the acquisition and use of exclusive rights to a trademark under certificate № 299467, constituted unfair competition.

In its resolution, the operative part of which was published on 11.01.2007, the Federal Arbitration Court of the Moscow Circuit dismissed the cassational complaint and left in force the ruling of the Arbitration Court of the City of Moscow of 19.06.2006 and the resolution of the Ninth Arbitration Appeals Court of 17.10.2006, and dismissed the claim filed by CJSC “KASKOL” Group of Companies ” against LLC “Volga-Dnepr-Moscow” and LLC “VDK-Invest”, calling for the acknowledgement as invalid of the purchase-and-sale contract of 4 320 ordinary registered shares in CJSC “Volga-Dnepr Airline Company ” and the application of the consequences of the transaction’s invalidity in the form of restituting the parties to their original position.

The Moscow City Court dismissed the cassational complaints filed by the Federal Communications Agency and the State Committee on Radio Frequencies against a decision of the Presnensky District Court of the City of Moscow.

On 05.12.2006, the Moscow City Court considered two cassational complaints against decisions of the Presnensky District Court of the City of Moscow that upheld the legality of the actions of the Federal Antimonopoly Service (FAS of Russia) in the matter concerning violation of antimonopoly legislation № 1 07/600-05.
