The Head of the Intellectual Property Department of the law firm “YUST” took part in the work of a seminar dealing with the problems of “Current issues of the legal protection of industrial property”

The seminar devoted to the problems concerning “Current issues of the legal protection of industrial property” was organized by the Russian State Institute of Intellectual Property and has occurred over the past several years. It is attended by the managers of patent services, patent specialists and patent attorneys.

On 23.11.2004, the main subject under discussion related to protection from unfair competition. In his presentation on this matter, the Head of the Intellectual Property Department of the law firm “YUST” referred to the activities of the antimonopoly bodies in their efforts to curb unfair competition. He described the history of the creation of antimonopoly bodies and the formation of legislation on competition, the application of the provisions of acting legislation on protection from unfair competition resulting from the violation of exclusive rights and the measures employed by antimonopoly bodies against unfair competition.

The greatest interest of the participants centered on questions of the application of the RSFSR Law of 22.03.91 № 948-1 “On competition and the limitation of monopolistic activity on the commodities market” regarding rights to the protection of brand names, and also the acknowledgement of competitive activity in the acquisition of brand names as unfair competition. It should be noted that the application of the provisions concerning unfair competition in violations of this nature became possible after the introduction of amendments to antimonopoly legislation, and corresponding legal practice is developing more slowly than would be desirable.
