One of our readers accidentally transferred money to her contractor’s old account, and the money were lost. The bank is in no hurry to return the payment made by mistake. Bankers and independent experts share their thoughts on how to resolve the problem.

«…The banking details of our supplier changed early this year. But when our accountant paid money in January, he filled in the old account number by mistake. The contractor closed that account and ceased working with that bank. The amounts paid by mistake usually come back within three to five days, but it has been two months already this time. And the amount is large – over a million. And according to the counterparty, the bank is in trouble and may lose its license anytime. How do we recover the money?..»

— The matter must be resolved ASAP. First of all, a letter demanding the return of the money should be drawn up. If the bank ignores it, then the claim to recover undue enrichment and the interest for illegal use must be filed with a court. The judges support the companies. See, for example, the award No. А56-68302/2013 dated 16.10.14 by the Court of Arbitration of the North-Western District.
