There is a chance that the advocacy may very soon receive an upgraded advocate’s query, which is one of the most important instruments in the advocate’s activity. The draft law announced by the Ministry of Justice is aimed at its reform. According to the regulator, this mechanism of obtaining evidence may be made more popular by way of making the legislation more specific, in particular – by determining the form and the content of an advocate’s query, liability of officials and other addressees for non-provision of information or for deliberate provision of false information in response to the advocate’s query, and also for the delays.
Solution of the tasks given to the Ministry should stimulate the creation of a serious instrument of collection of evidence by advocates, which in turn will influence the development of professional representation. What is your opinion on this legislative initiative?
