Free legal assistance to a foster mother, who undertook the upbringing of a disabled child.

This complicated story began in 2003, when an alcoholic mother of five, who had been removed of her parental rights in 1999, let her youngest child, a boy of five years, fall out of a7th storey window. Against all the odds, the child survived, but lost the use of his legs and was left with many serious health problems.

This serious occurrence was brought to the attention of the authorities, who had previously ignored the fact that five children lived with an unfit mother for four years. The boy became disabled and was migrated from one hospital to another, from under one tutelage to another, until he eventually ended up in an orphanage specializing in distributing children among foster families. Having been with two foster families chosen by the orphanage, the disabled child ended up in 2005 with the family where he lives today, thanks to the advocates of the Law Firm "YUST".

The biological mother of the boy won her parenting rights over two of the children back in 2009 (two others were of age already by that point). However, the court dismissed her claim for the parenting rights over the youngest disabled son. The mother, who had never visited the boy and never so much as inquired about his health, was not satisfied with this. As a response to the prosecutor’s office claim to increase the amount of the alimonies exacted from her, she filed the counterclaim to restore her to the parenthood in 2012. The first instance court took the side of the biological mother and restored parental rights.

The specialists of the orphanage and the foster mother, who had taken care of the child for over 6 years, requested the Law Firm "YUST" to assist in the representation of the patronage mother’s interests in court.  The second instance court considered the complaint filed by the advocates in the end of 2012 and dismissed the biological mother’s request for restoration of parental rights, leaving the child to live with the foster family.
