A client demands that an investment company pay her 500 thousand roubles for failures
The Moscow Court of Arbitration received a lawsuit by Anna Pilipenko against “FINAM Investment Company” CJSC. The claimant, who was and still remains a client of FINAM, requests that the recalculation of the margin level be ruled incorrect. The amount of Mme. Pilipenko’s losses could not be ascertained. However, the offended client of the brokerage company demands that FINAM be brought to administrative liability and fined accordingly – 500 to 700 thousand roubles.
…Last summer, A.Pilipenko caused a check by the Federal Service on Financial Markets to hit the FINAM holding. The client of the investment company was convinced that her unlucky trading at the exchange was the incorrect information on the margin level supplied to her by the broker on May 17 of 2012 since 11 hours 35 minutes 58 seconds of the clock till 11 hours 36 minutes 14 seconds of the clock. FINAM was forced to report to the FSFM on its calculations, but no violations were discovered. Therefore, according to the company’s representative, despite that “any company may make mistakes, even more so – if there are many clients”, the case of Anna Pilipenko does not fall within that category, and there were no “frequent cases of violations by the broker and of supplying false information”, as the statement of claim says, whatsoever.
FINAM has its own version of the events
The FINAM representative explained to Izvestia: “The reason behind A.Pilipenko’s claim against our company, as we see it, is the difficulty for her to understand – taking into account her preparation level – certain objective peculiarities of margin trading”.
Yulia Zhbankova, the Judge of the Moscow Court of Arbitration, has left the claim by A.Pilipenko against FINAM without movement, giving the claimant two weeks to supply the documents of notifying the opponent and payment documents for the 28 thousand roubles of state duty, and to correct her claim.
Meanwhile, the experts take their time expressing optimism regarding the claim.
Alexander Bolomatov, Associated Partner of the Law Firm "YUST", says: “When one starts exchange operations, he expects large earnings. And this means that there are fewer chances – such are the rules of the game. In brokerage, nobody guarantees stable income”.
Still, there are more opportunities for the client to settle the matter with the broker extrajudicially – some bonuses or compensations may be expected in this case. He added that the chances to punish the investment company in court are approaching zero.
