A patronage family managed to protect the interests of an underage disabled boy
In December of 2003, S.N.Sakharova’s 5 year old son fell out of her flat on the 7th floor, when she was in there. No criminal investigation was initiated, so the causes of this are unknown. The boy’s fall was followed by a long period of treatment, after which he was put in the Moscow orphanage No. 19 “Patronage education center”. S.N.Sakharova showed no interest in her son’s life and fate during the entire period of his treatment, stay at the orphanage and at the patronage family. Countering the claim by the city prosecutor of Noginsk to increase the alimony amount, she moved a counterclaim to be reinstated as a parent. The Noginsk City Court, holding three court sessions in 14 days, discovered “sufficient reasons” to uphold her claim.
Only S.V.Murashkina, the patronage educator of the underage disabled boy, who has the status of a third party, filed an appeal with the Court of the Moscow Region. Yury Karpov, lawyer, and advocates of the Law Firm "YUST" Olga Artiukhova and Tatiana Starikova represented her interests at the Moscow Region Court.
Advocate Elena Lvova, Head of Criminal Procedure Practice of the Firm, rendered them full support in the case.
The Court of the Moscow Region on July 17, 2012, revoked the judgment by the Noginsk City Court dated April 19, 2012, and delivered another ruling on the case, refusing to reinstate S.N.Sakharova as the parent.
