Antitrust regulation - 2012

On February 15, 2012 the Law Firm "YUST" held a seminar for the in-house lawyers of ROSNANO OJSC.

The event focused on the third antitrust package: changes to the legislation and perspectives of its application.

Advocate Arthur Rokhlin, Partner at the Firm, Advocate Anna Kotova-Smolenskaya, Associated Partner at the Firm, and Radmila Nikitina, acting Chief of the Antitrust Law Practice at the Firm, spoke at the event.

The specialists of the Firm together with the participants discussed the legal novelties regarding:

• The principle of exterritoriality of the Competition Protection Law;
• The criteria of a group of persons and practical patterns of its creation;
• Antitrust (state) control over economic concentration;
• The requirements to agreements, the concept of anti-competition agreements and coordinated actions.

The issue of the procedure of inspections by the antitrust authority got the audience’s attention, as did the search for the border between the operations of law enforcement agencies and the activities of the FAS at performing inspections.

At the end of the seminar, Arthur Rokhlin, Partner at the Firm, answered the questions of the audience on how to act in certain difficult situations arising in practice.
