Arbitration judges will have the same rights as common judges

The RUIE suggests raising the status of arbitration judges and discussing the possibility to initiate criminal cases against them only if sanctioned by a court or a prosecutor. Such procedure is currently in force towards judges on criminal cases and arbitrators.

Nowadays the independence of judges is guaranteed by their immunity from criminal prosecution, which can only be lifted by the Prosecutor General’s Office upon sanction of the Supreme Qualification College of Judges (SQCJ), Alexander Bolomatov, Partner of the Law Firm "YUST", explains. He says: “Only the SQCJ may sanction a criminal prosecution of a judge”.
