BigBuzzy is running out of coupons
BigBuzzy discount service filed for bankruptcy for the motive of a sharp decrease of the number of the resource’s visitors. The lawyers warn that the company may keep attracting clients until the moment of its dissolution.
According to the documents published at the website of the Moscow Court of Arbitration, the owner of BigBuzzy coupon service filed with the court a request to rule him bankrupt. The BigBuzzy site remains operational for now. BigBuzzy representatives were unavailable for comments.
According to the information by I’son & Partners Consulting, in January and February of 2012 BigBuzzy was among the five best visited discount services, with over 126 thousand visitors per month. But the popularity started decreasing in May and June, while the number of complaints by the clients grew.
Alexander Bolomatov, Associated Partner of the Law Firm "YUST", believes that the company’s request for bankruptcy may be a means of defense against creditors. The lawyer points out: “As of now, there is only the request. Economic activity may continue throughout the entire bankruptcy process up to the very dissolution of the company, even during the sale of the bankrupt estate”.
The existing agreements of the discount services with their clients do not make them responsible for non-performance under the agreements.
The offer agreement at the BigBuzzy website says: “the Agent is not responsible to the consumers for the volume, quality, period and conditions of rendering or for non-rendering by the Principal of the set of services indicated in the coupon. All demands, claims, lawsuits related with undue rendering or non-rendering of the set of services indicated in the coupon as well as with the reimbursement of money on these bases shall be done directly to the Principal”. There is a reservation that the company is ready to provide “all possible cooperation” in order to settle the dispute.
The other companies, which render discount services, refused to comment on the situation of the competitor’s bankruptcy.
In August, the Moscow section of the Federal Service of Supervision in the Sphere of Consumer’s Rights and Human Well-Being (Rospotrebnadzor) recommended that the consumers should “employ more prudence while dealing with the companies, which distribute discount coupons and product purchase certificates”. The authority believes that Russian clients of Internet discount services lack legal protection.
