Civil proceedings will be reformed

Chairman of the Supreme Court of the Russian Federation Vyacheslav Lebedev told about the changes to the CPC, which will be suggested. Those include a simplified proceedings system, a wider sphere of application of obligatory extrajudicial settlement, shorter appeal periods and certain other measures. In general, all initiatives stick to the trend of unification of the procedural law and decrease the currently large workload of the judges. Advocate Alexander Bolomatov, Partner of the Law Firm "YUST", does not like the idea to forgo the preamble either: “Motivating its position is one of the duties of the court. There cannot be a situation, when a court decides that it is so because it is so. If motives are given, one may debate with the court, if no motives are given – one cannot”. In his opinion, the absence of a preamble “strikes the floor from under the appeal”, and the possibility to draw up a preamble if requested by the parties does little to improve the situation.
