Compensation of sanctions

The project of compensation from the budget for the Russian elite that has been affected by sanctions caused many discussions in the governmental and juridical communities.
The lawyers split into two large groups. One group is indignant: the draft law infringes the sovereignty of foreign states, disrespects their legal system, and actually only gives a semblance of legitimacy to the confiscation of the offenders’ property. The second group points out that Russia is merely reacting to sanctions and passes the idea that those, who support the policy of the State, should not bear losses in connection with the fact that some foreigners do not agree with such policy.
Managing Partner of the Law Firm "YUST" Evgeny Zhilin says: “The need to compensate from the budget funds the very losses caused by the sanctions as well by other actions of the authorities and officials of foreign states seems to me like an extremely debatable, and even unconstitutional, idea. Such idea affects the equal rights principle, at the very least, and infringes upon the limits of constitutional guarantee of compensation of the harm done by illegal actions of public authorities”. In his opinion, if the decisions to impose sanctions are legal and comply with the legislation of the foreign state, there are no reasons for compensations from the Russian budget. However, E.Zhilin says, the idea of providing legal assistance to the victims of the sanctions appears interesting: “I believe we should elaborate the mechanisms of rendering such assistance and sources (and limits) of funding”.
