Domestic energy disputes: the three categories

Partners of the Law Firm "YUST" Evgeny Zhilin and Alexander Bolomatov spoke as experts for the London-based Commercial Dispute Resolution magazine, having pointed out three categories of domestic energy disputes:
• Energy companies under review by the Federal Antimonopoly Service
Alexander Bolomatov says that competition lawyers understand the power of the antitrust authority and take it very seriously: «They do a lot of litigation, they are very keen on it, they are very good at it and they win a lot of cases, even when they have disputes with the very serious players and the state-owned players».
• Energy companies’ protection of rights through litigation
Evgeny Zhilin explains: «These disputes concern access to energy – new plants being installed, and of course there is always an issue of who gets the access and how ». These often overlap with antitrust and commercial pricing disputes. They are not necessarily a good line of work for Russian law firms.
• Energy disputes surrounding non-payment
The Partners say that such cases are numerous but small and handled mostly in-house.
Overall, E.Zhilin sees a stable domestic energy market for lawyers, relatively unaffected by the global financial crisis, and thus not prone to an increase in major disputes.
