Energy sector workers will attempt to find the 3 billion roubles at the ground floors of residential buildings

MOEK OJSC jointly with local councils and prefectures of Moscow will check the non-residential premises in the residential buildings of the capital city in July. Their heating debts have reached 2 to 3 billion roubles.

MOEK representatives say that managing companies and owns of the buildings will be fined, if they have not executed separate heating agreements for non-residential areas.

The late debts of the managing organizations to MOEK reached 20.2 billion roubles at the end of the first quarter of 2015. According to the company, 2 to 3 billion roubles of the debt are due fr om the built-in premises and annexes of multi-flat buildings.

According to MOEK, a portion of the premises in the city have been reformed and turned into non-residential premises for shops, barber shops and cafeteria, but the owners of the buildings did not inform the energy sector workers of that. This means lost profits for the energy sector, and expenses for the city: the tariffs for the populace are subsidized from the city budget. MOEK has discovered since 2012 1200 buildings on its own, wh ere heating of non-residential premises was not included in the supply agreement. The energy company issued bills for 154,6 million roubles for 400 buildings.

According to the city property department of the city of Moscow, 489 objects were transferred from the residential to non-residential fund in 2013, 179 objects – in 2014. 34 decisions to transfer residential premises to non-residential premises were taken in January – April of 2015.

Alexander Bolomatov, Partner of the Law Firm "YUST", says that no civil law liability is established for the owners of the buildings and the non-residential premises for non-informing MOEK. The lawyer believes that if MOEK becomes aware that the building has been reformed, and the respective changes to the agreement with the heating suppliers were not made, the company may re-calculate the sum in accordance with the new tariff and exact it for the period, when the building had already been reformed and the agreement with MOEK was not re-executed. A.Bolomatov pointed out: “Sometimes an agreement may stipulate the amount of the fine, which MOEK may exact, if the building is reformed and no changes are made to the agreement”.

MOEK is owned by Gazprom Energoholding. It won the auction on purchase of 89.98% of the shares of the energy company from the government of Moscow in August of 2013. The Gazprom subsidiary paid 98 billion roubles for the asset. The buyer increased its interest to 98,7% by consolidating the assets of MOEK Finance, which had owned 8,9% of MOEK.
