FAS will allow courts to sell patents without consent of right holders

The Federal Antimonopoly Service invented punishment for copyright holders abusing their domination - amendments to the Civil Code of Russia are proposed to punish them with forced transfer of license to use the invention. The right to recourse to court will be granted to the agency itself and to the company ready to produce equivalent goods.
Adviser of YUST Law Firm, member of the expert council under the FAS of Russia Dmitry Seregin told Pravo.ru portal that the proposal of the service will first of all negatively affect the excess profits of companies that hide behind patents and play on artificial deficit of their products in the Russian market: “Domestic enterprises, primarily small and medium, that can set up production based on already patented technologies, will benefit. Besides, this proposal will have an overall positive effect on domestic industry that may gain access to “monopolized” technologies.”
