How will the antitrust regulation change in 2013? A lawyer of the Law Firm "YUST" explains

On November 15, Vitaly Grebennikov, lawyer of the Law Firm "YUST", spoke at the three-day seminar of the Statut Law School themed “Competition Protection Law: application practice, commentaries to the amendments. Third antitrust package”. Members of the Higher Court of Arbitration of Russia and of the Federal Antitrust Service of Russia also spoke at the event.

V.Grebennikov called the listeners’ attention to the novelties of the Third antitrust package and judicial practice on the matters of abuse of dominating position.

Within the frame work of the first subject, the expert told of significant novelties made to the Competition Protection Law. According to him, the antitrust authorities will end up with more ways to influence the subjects of economic relations, and it is the lawmaker’s intention that the quality of antitrust regulation should improve. Meanwhile, certain drawbacks of the antitrust regulation remain.

The audience was especially interested in the matters of administrative liability for abuse of dominating position. V.Grebennikov, recalling some examples from the judicial practice, told in detail:

  • Of the circumstances, which alleviate and aggravate the liability;
  • The way of calculation of sanctions for the offences stipulated by part 1 of Article 14.31 of the Administrative Offences Code of Russia;
  • The application of working fines and what is so remarkable about the Petrozavodsk public supply systems case.

The next antitrust seminar will be held in late February – early March of 2013.
