“In our opinion, the claimant has abused his procedural rights…”

A subject was raised in the program “We speak and we show” on February 15 regarding the acclaimed dispute on what amount of services the managing company had to render and whether it was liable for theft from a resident’s flat.

We remind that on February 6 of 2013 the Moscow City Court revoked the ruling by the Zamoskvoretsky District Court dated September 10 of 2012 to the favor of the claimant – a cinema and theater actor Andrey Sokolov. The second instance favored the respondent’s case – the DEKRA-Stroyekspluatatsiya CJSC managing company. The court concluded that managing companies should not be held liable for thefts from apartment buildings.

Alexander Bolomatov, who had represented DEKRA-Stroyekspluatatsiya CJSC in court, commented on its legal position and explained why the claimant’s conduct may be considered abuse of his procedural rights.
