Lawyers approve of the idea to speed up consideration of business disputes by the courts

The experts are positive in their evaluations of the suggestion, made by Vladimir Putin, Chairman of the Government of the Russian Federation, to speed up consideration of business-related court cases. Such was the opinion of reputed Russian advocates voiced by them in response to questions by RAPSI/reapsinews.ru agency.

Speaking at the “Forum Russia-2012”, the Prime Minister said Thursday that “the procedure of consideration of business-related court cases must be sped up as much as possible, and the time limits for eventual appeals against the decisions – extended”. V.Putin also stated the necessity to provide for the opportunity to join administrative and property cases within the framework of execution proceedings.

Alexey Popov, Advocate, Partner at the Moscow Bar Association “Law Firm "YUST"”, believes that “the suggestion of the Prime Minister to speed up consideration of business-related court cases is welcome news for the business”. “However, the quality of the court system work rather than procedural periods of case consideration is where the main problems of court practice lie”, - said the advocate. A.Popov is of the opinion that “there is a risk, in this connection, that the courts might speed up the process of administering justice at the cost of its substance”.

Meanwhile, the suggestion to exact trial costs and other compensation to the benefit of businessmen from public officials and state authorities, who lose the disputes, should be welcomed without any reservations, says the Advocate.
