Expensive competitiveness The government views the principle of competitiveness in the new draft of the Administrative Offences Code with suspicion – the necessity to summon policemen and officials who drew up protocols may lead to large financial expenses. Representatives of the government announced this in the final session of the State Duma dedicated to the new Administrative Offences Code - its first reading may take place already at the beginning of March.

On the part of the deputies this is definitely an attempt to liberalize administrative law, without the competitiveness principle there is no need of a new Administrative Offences Code at all, partner of YUST Law Firm Alexander Bolomatov shared his opinion with Vedomosti newspaper: “The court is not a representative of any of the authorities, it is independent, and competitiveness is the responsibility of the parties”. Appealing against actions of a governmental authority now can be infinite and ineffective, and competitiveness gives more chances to establish one’s case. Governmental authorities have legal departments and relevant professionals, participation in competitive proceedings is a matter of self-control for them, the lawyer believes. If the government argues with this provision and spares money for competitiveness, it refuses to cure cancer cells inside itself, Alexander Bolomatov is convinced.
