Public-Private Partnership – 2013. Experts discussed the peculiarities of implementation of projects

Investing into Russian infrastructure has been one of the main trends during the recent years. The State needs the assistance from the private sector for elaboration and implementation of infrastructure development objects. However, due to the fact that there is no dedicated federal law on public-private partnership (PPP), the draft of which is only now being considered by the State Duma, there are many problems in carrying out those projects.

The Moscow Times conference “Public-Private Partnership – 2013” is over. Its participants learned about the latest legislative changes in the PPP sphere, the possibilities and instruments of attracting funds to PPP projects. Leading PPP experts, representatives of public authorities, large banks, developers and transportation companies, private investors et al. took part in the sessions. The session “Trends of development of the Russian PPP market” was moderated by Advocate Alexey Popov, Senior Partner of the Firm. Within the framework of that session, acting Head of Antimonopoly Law Group Radmila Nikitina told about the main differences and the division of spheres of validity of the legislation on official purchases and the PPP legislation. The expert pointed out the drawbacks of the legal regulation and also expressed some ideas in the search for a balanced approach when delimitating the PPP agreements and official contracts. In the course of discussion of the matters of organization of PPP, Advocate, Doctor-at-Law Anna Kotova-Smolenskaya, Partner of the Law Firm "YUST", shared the juridical aspects of PPP agreements with the members of the Conference: what main mechanisms of implementation of PPP are preferred in Russia and abroad, what factors affect the choice of the type of the agreement with the State, what the correct way to structure a project is. Also during the Conference, the experts exchanged opinions on the practice of holding PPP-auctions, on transport infrastructure projects and projects of integrated development of territories for the purposes of residential construction.
