Safety measures when dealing with know-how by Advocate of the Law Firm "YUST"

The Government of Moscow together with the organizations and foundations of support for businessmen held on November 30 a Conference “Optimization of registration procedures for property titles”. Representatives of Rospatent, of expert and analytical center of the HSE, of the Center of Business Development of Sberbank of Russia, of the Realty Section of the Department of Property of the city of Moscow, of the marketing section of the Specialized State Unitary Venture on sale of property of the city of Moscow, of profile educational institutions of the city of Moscow, of small and medium ventures of Moscow, and of large law, consulting and audit firms.

The Conference was composed of a plenary session and two round tables:

• “Registration of rights and protection of intellectual property objects”;
• “Practice of resolution of basic issues of registration of immovable property objects”.

Denis Shumskiy, Advocate of the Law Firm "YUST", spoke at the first round table and told on the main advantages of know-how as compared to patents during commercialization of intellectual property results. He drew special attention to the peculiarities of registration of rights to intellectual property results.
D.Shumskiy pointed out that, since the moment the rightholder takes the decision on legal protection of information on technical or other research product in the form of know-how, said information becomes a protected result of intellectual activity.
The rightholder may freely use such research product in any legal way, including the implementation into production or putting into market of a product based on the research. Also, the expert believes that formalization of the exclusive right to know-how may provide the rightholder with significant advantages, when the results of intellectual activity are introduced into civil circulation.
The members of the round table also discussed the planned amendments to the Civil Code. D.Shumskiy commented on the novelties, which are suggested for introduction into the know-how rights part. After his speech he answered the questions of the Conference participants.
