Alexey Prokhorov, Senior Associate of the Tax and Customs Law Practice of the Law Firm “YUST”, commented for the Russian Business Newspaper on the letters (Nos. ГД-4-8/18401@ and ГД-4-8/18402@ dated 21.10.2015) of the Federal Tax Service, which clarify the mechanism of exaction of arrears from individuals: "Such mechanism of debt exaction will be popular with the tax authorities. That is because the bulk of the exaction work will be effectively imposed on the employers, who will dutifully perform withholdings under the threat of a punishment ".
The FTS points out that the exactions will not be made from the employer’s funds. Companies will transfer the amounts of the tax arrears of their employees, but those will be deduced from the salary and other periodic payments of the debtors. Whereas the amount of the withholdings from the employee’s salary is limited and cannot exceed 50%, according to Article 99 of the Federal Law No. 229-FZ “On execution proceedings” dated 02.10.2007.
