Scientific commentary to the Advocate’s Code of Professional Ethics. Second edition

23.09.2013

The second edition (revised and expanded) of the book “Advocate’s Code of Professional Ethics: scientific commentary” was published under the auspices of the Federal Chamber of Advocates of Russia and the Institute of Advocacy of the Oleg Kutafin Moscow State Academy of Law. Managing Partner of the Law Firm "YUST", First Vice President of the FCA of Russia, Doctor-at-Law Yury Pilipenko is the author of the book.

The VI All-Russian Congress of Advocates that occurred on April 22 of 2013 approved 140 amendments to the text of the Code, and this was the cause for the second edition. The Code, adopted in January of 2003, is not only the moral law of the advocacy, but also an actual guideline for the activity of advocates, bar associations and chambers of advocates. The text of the amendments, which allows comparing the former and the current editions of the Code, is included in the new edition as a supplement.

President of the Federal Chamber of Advocates of Russia, Honored Lawyer of Russia E.V.Semenyako: “The work of the Congress, in my opinion, demonstrated the undisputable interest of the advocates’ community in strengthening the moral grounds of the profession and consolidating each advocate’s responsibility for complying with the ethical standards of our corporation. It is important to note that the results of the Congress are evaluated by the advocates’ community and by the state authorities, including the Ministry of Justice of Russia, in this manner exactly. <…> The correct understanding of the definition of professional activity and of the limits of disciplinary liability of an advocate is a crucial point for the perception of the position defended by Y.S.Pilipenko in this Commentary”.

President of the Chamber of Advocates of the city of Moscow, Honored Lawyer of Russia G.M.Reznik: “…Y.S.Pilipenko promptly reacted to the amendments by revising and expanding his author’s Commentary to the Code. The scientific component of the Commentary has been greatly enhanced. The Commentary’s pages contain different views on perpetual and newborn matters of the advocate’s profession. Together with the study of the disciplinary practice, the doctrinal interpretation of the Code’s provisions enables the advocates as well as all those, who are interested in the problems of the Bar, to receive a comprehensive idea of the advocate’s ethics and of the situation in the modern-day Russian Bar”.

The Commentary is intended for use by advocates, heads of chambers of advocates and Bar associations, by members of qualification committees and councils of chambers of advocates, advocacy legislation specialists as well as by students, professors, post-graduates of law faculties and by all those, who are interested in the problems of the Bar.
