The authorities of Crimea received the right of compulsory confiscation of private property
The Government of Crimea was granted the right of compulsory buy-out of “strategic objects”. Lawyers warn that the document is worded in such a way that it may affect land or realty as well as any company.
There are also separate laws for an accelerated procedure of confiscation of land plots for public needs. They were adopted to regulate land relations in the area of Olympic Games in Sochi and in the territory of New Moscow. In Sochi, the State formed a “maneuverable fund” of residences intended for providing those citizens, whose residences were confiscated, with flats. The similar procedure was done towards the owners’ land plots.
Alexander Bolomatov, Partner of the Law Firm "YUST", is surprised: “The authorities usually resort to the proceedings under the Civil Code, and adopt federal laws exactly for the accelerated purchases, while local authorities adopted the law in this case”. The law on admittance of Crimea to the Russian Federation gave them such right for the duration of the transitory period. Its Article 23 enables the local authorities to follow their own laws for the duration of the transitory period until 2015 towards those companies, which have not yet completed their re-registration under the Russian jurisdiction.
