The court decided to convict Navalny before the New Year
The sentence for Navalny brothers on the Yves Rocher case will be read on December 30 at 9 o’clock in the morning instead of January 15. A representative of the Zamoskvoretsky court of the city of Moscow says that the transfer is due to that the sentence is already made. Lawyers not involved in the case, when questioned, say that this is the first time in their practice, when the sentence is read earlier. Here is one of the opinions.
Alexander Bolomatov, Partner of the Law Firm "YUST": “When the reading is transferred to an earlier time, there is no formal contradiction, it is allowed, even if not seen in practice. I’ve never heard of any such cases. It is perhaps better for the parties to the trial, if the sentence is an acquittal, and the restriction is lifted from the defendant. If the sentence is a conviction, and deals with actual imprisonment, for example, the fact that the defendant is under restriction is considered arrest, while the defendant is actually at home”.
Alexey Navalny and his brother Oleg are charged with theft of 26 million roubles from Yves Rocher Vostok Company and of another 4 million – from the Multi-Profile Processing Company. The defendants deny all charges. The prosecutor requested 8 years of regular imprisonment for Oleg Navalny, and 10 years – for Alexey, in consideration of his earlier conviction on the Kirovles case.
