The fan, who injured Shunin, may be brought to criminal liability
Advocate Alexey Popov, Partner of the Law Firm "YUST", told “R-Sport” information agency that the football fan, who had injured Anton Shunin, goalkeeper of Dinamo football club, with a firecracker, could be brought to criminal liability.
The match of the 16th round of the Russian Championship between “Dinamo” of Moscow and “Zenit” from Saint Petrsburg Saturday was interrupted because of the use of fireworks by the fans. A firecracker exploded near the goalkeeper of the hosting team Anton Shunin and injured him.
During a telephone conversation, A.Popov said: “If the fan, who injured A.Shunin with a firecracker, is identified, he may be brought to liability for health damage, if any. To criminal liability too, if the damage is classified as serious enough. As far as I know, the medic said that the cornea was damaged, and Shunin’s vision has deteriorated. The fan may also incur civil law liability in the form of compensation of treatment expenses and restoration of damaged functions costs, and also moral damages. The entire country has seen this, this is an insult”.
The lawyer said that the offender also faced liability to the RFPL for the interrupted game.
A.Popov stated: “Should it be ascertained that the referee interrupted and cancelled the game in conformity with the Regulations, the fan will may be liable to the organization that holds the competition, in this case – the RFPL. It is a civil law liability connected with the partial compensation of the damage done by the suspension of the game”.
The advocate explained that the fan, who had injured Shunin, cannot be banned from stadiums according to the law.
The lawyer elaborated: “Our legislation on this matter is underdeveloped. Persons, who want to move freely and do what they want, cannot be banned from the stadiums. We cannot suggest such measures until the respective law is adopted – and it cannot be adopted post factum”.
