The Law Firm “YUST” and “Schalast & Partner” – an across-the-border cooperation
Artem Boyko, LL.M., Doctor at Law, Lawyer at the Law Firm "YUST", took part in the annual international program of advanced training for lawyers from Central, Eastern and Southeastern Europe. The program, organized by the German Foundation of International Legal Cooperation (Deutsche Stiftung für internationale rechtliche Zusammenarbeit) together with the German Federal Bar Association (Bundesrechtsanwaltskammer) and the German Union of Advocates (Deutscher Anwaltverein) was held since August 22 till October 1, 2011.
19 lawyers from 14 countries – Bulgaria, Estonia, Georgia, Croatia, Lithuania, Poland, Romania, Serbia, Slovakia, Slovenia, the Czech Republic, Hungary, Turkey and Russia – took part in the program in 2011. This year, Artem Boyko was the sole representative of our country.
The program consisted of three stages. The first one was a 10-day seminar in Bonn dedicated to pressing issues of the German and European civil, commercial and business law. Practicing lawyers of leading law firms of Germany, including CMS Hasche Sigle, B.B.O.R.S. Kreuznacht Rechtsanwälte, BridgehouseLaw, and others, delivered lectures. Participants of the program discussed during the seminar:
- Peculiarities of conducting M&A transactions;
- Practice of executing international sale and purchase agreements with the account of the German Civil Code and Vienna Convention on Contracts for the International Sale of Goods;
- National specifics of bankruptcy procedure;
- Problems of recognition and execution of foreign court acts.
Moreover, a case study was organized, which permitted to compare the perspectives of resolving said problems, following the national legislation of each participant.
Second stage – training courses in separate law firms around Germany. Artem Boyko took such a course with the advocates’ company „Schalast & Partner” (Frankfurt-am-Main), which is a partner of the Firm within the MULTILAW. During the course, he participated in the legal support of an international investment project of mining for resources in the CIS countries, including Russia.
Third stage – final seminar in Bonn and Brussels, where the participants shared their impressions of the training courses, exchanged contacts and planned on continuing the international cooperation.
