The sluggishness of the authorities will be compensated from the budget

Come next year, Russians will be able to receive compensations for procrastination of execution of court acts concerning property disputes. The respective draft law has been elaborated by the Ministry of Justice of Russia. According to the idea, this will be cheaper for the budget than paying under the numerous resolutions passed by the European Human Rights Court (ECHR).

The Ministry of Justice elaborated a draft law, which legally fixes “the right of any individual or legal entity to go to courts requesting awarding compensation, if the respective right to execution of a court act within a reasonable time is breached”. The State and local authorities are charged with execution of such claims. It is about the various property disputes and claims underway in Russian courts <...>

Alexander Bolomatov, Partner of the Law Firm "YUST", told NG that the elaboration of the draft law was due to the huge amount of complaints from Russia to ECHR against the time limits for execution of judgments: “This is currently the subject responsible for most complaints to the ECHR from our country”. And the State, according to A.Bolomatov, is the main offender: “Therefore, it is hard to tell how the final adopted act will look like. I think the law will face many opponents. However, it is obvious that this law only will not be able to change the entire system of procrastination, and the lesser part of judgments is actually executed in our country”.
