Ukraine wishes to receive gas via Stockholm

Ukraine continues its search for different ways to resolve the matter of supply of the Russian gas.


Ukraine continues its search for different ways to resolve the matter of supply of the Russian gas. On one hand, Kiev suggested that Gazprom should get back to the lowest possible price of $268 for 1 thousand cubic meters. On the other hand, it is preparing a claim to the Stockholm Arbitration demanding to rule the agreement executed between Naftogaz and Gazprom in 2009 invalid.

According to Advocate Evgeny Zhilin, Managing Partner of the Law Firm "YUST", judicial disputes on the price or the amounts within the framework of a contract of gas supply are quite common. In his opinion, Ukraine will demand termination of the agreement, since it would be nonsense to contest it after years of performing by both parties. However, as the lawyer points out, one party’s desire is not enough to terminate the contract – the facts of breaches committed by the respondent, which have led to the impossibility to perform under the agreement, are needed. E.Zhilin says that if Ukraine actually files the claim, its consideration will take approximately two years, during which Naftogaz will be obliged to perform under the contract.
