Anti-crisis management in the modern-day economic conditions

The round table “Anti-crisis management in the modern-day economic conditions” was held in Moscow on November 26 of 2013 with the support of the State Duma of Russia, of the FTS of Russia, of the HCA of Russia, of the Russian Union of Industrialists and Entrepreneurs within the framework of the enlarged meeting of the Committee on Security of Entrepreneurial Activity of the Chamber of Commerce and Industry of Russia.

Senior Partner of the Law Firm "YUST", Advocate, Doctor-at-Law Artem Kukin represented the Firm as one of the experts. Deputy Chairman of the State Duma Committee on financial markets Anatoly Aksakov delivered a welcoming speech to those present. He voiced the amount of late debts on bank credits of the Russians – over 420 billion roubles. In this connection, he suggested that the experts invited to the event should discuss the measures of improvement of the insolvency (bankruptcy) law aimed at the protection of the citizens’ rights and determine the perspective and the most efficient methods of work in the sphere of anti-crisis management. Georgiy Agaptsev, Director of the Department of Restructuring of Banks of the Agency of Deposit Insurance, elaborating on the theme of the event, told about the mechanisms of sanitation of financial organizations. In his turn, Deputy Head of the FTS of Russia Alexander Varvarin emphasized the topical matters of debt settlement and security of bankruptcy procedures. The experts have also paid attention to such problems as: the lawmaker’s consideration of the interests of the business; improvement of efficiency of the bankruptcy procedures; evolution of a new legal institution – bankruptcy of individuals; anti-crisis management in the conditions of financial insolvency from the viewpoint of penal procedural legislation etc.

Senior Partner of the Law Firm "YUST", Advocate, Doctor-at-Law Artem Kukin actively participated in the discussions on the perspectives of development of the Russian bankruptcy law, including in the light of the arguable and ambiguous positions reflected in the explanations given by the Plenum of the HCA of Russia in 2013. A webinar with the participation of the expert will take place on December 9 of 2013, where one will be able to learn in detail about the problems of expansion of the judges’ discretion in consideration of the requests of invalidity of the debtor’s transactions and the enlargement of the group of subjects of contestation of the transactions, in proving the creditor’s awareness of the debtor’s insolvency indicators and in the distribution of the burden of proof. The webinar will also deal with the problems of the banks as bankruptcy creditors, with the legal status of pledge creditors and the ways to fight dishonest affiliated creditors of the debtors.
