IX International Forum “Intellectual property – 21st century”.

On April 25-29, the Russian Chamber of Commerce and Industry under the guidance of the World Intellectual Property Organization held the IX International Forum “Intellectual property – 21st century”.
As part of this event, a session of the section “Legal protection of intellectual activity results and means of identification” took place on April 26 in the Institute of State and Law of the Russian Academy of Sciences, where YUST Law Firm took part.
Head of Intellectual Property Group of YUST Law Firm Denis Shumsky gave a report “Brand protection: current issues of judicial practice (case study: pharmaceutical products)”. The lawyer gave a detailed explanation of the questions arising among the pharmaceutical market participants in the course of registration and protection of trademark rights. The report was complemented by practical examples of appeals against refusals of Rospatent to register trademarks and of domain disputes. The report analyzed judicial practice on the issues of unlawfulness and abuse of rights during registration and use of trademarks, presented judgments concerning opposition of international unpatented names and trade names of pharmaceutical products, and considered the problem of relations between medications and dietary supplements in terms of defining the scope of trademark protection.
