Meeting with Judge Anatoli Gennadievich Pershutov, member of the Presidium of the Higher Arbitration Court of the Russian Federation

On 10 March 2006, attorneys of the Bar Association of the Moscow Region Law firm “YUST” attended a meeting with Judge Anatoli Gennadievich Pershutov, a member of the Presidium of the Higher Arbitration Court of the Russian Federation. The meeting was organized by the Federal Chamber of Advocates of Russia as part of the Chamber’s program for raising the qualifications of Russian lawyers.

In his address, A.G. Pershutov discussed the more important aspects of the activity of attorneys in the arbitration process at the stage of supervisory procedure, namely: the specifics of compiling applications for the review of court acts in supervisory order, the application of art. 304 of the Arbitration procedural Code of the RF by the courts (grounds for alteration or revocation in the order of supervision of court acts that have come into legal force), the order of determination and restoration of missed terms for the filing of applications for review of court acts in supervisory order.

In answer to questions from the attorneys present, A.G. Pershutov also outlined his own position regarding the development of the court practice of the Higher Arbitration Court of the Russian Federation on taxation disputes.
