Participation in the First All-Russian Congress of Arbitration Tribunals

The First All-Russian Congress of Arbitration Tribunals took place in the Congress Center of the Chamber of Trade and Commerce of the Russian Federation on 15 June 2006. The Congress was organized by the Chamber of Trade and Commerce of Russia and the Russian Center for the Support of Arbitration Tribunal Proceedings.

The proceedings of the Congress were chaired by the Vice-President of Chamber of Trade and Commerce of Russia, Doctor of Legal Studies, Professor V.B. Isakov.

The Congress opened with an address by the President of the Chamber of Trade and Commerce of Russia, academician of the Russian Academy of Sciences, E. M. Primakov, who focused on the primary problems in the sphere of alternative settlement of commercial disputes:

- coordination of the practices of arbitration tribunals and state arbitration courts in the application of acting legislation and international agreements;

- procedural improvement of arbitration proceedings;

- raising the qualifications of arbiters handling disputes;

- the use of contemporary information technologies, including video and audio recording of the court process;

- increasing the practice of pre-trial settlement of disputes with the aid of professional intermediaries.

The main address was delivered by Doctor of Legal Studies Professor E.A. Sukhanov, the Head of the department of civil law of the Law Faculty of the Lomonosov Moscow State University, Chairman of the Arbitration Tribunal for the Settlement of Commercial Disputes of the Chamber of Trade and Commerce of the Russian Federation and Chairman of Russian Center for the Support of Arbitration Proceedings. His address was devoted to matters concerning the current state of arbitration proceedings in the Russian Federation and the outlook for further developments.

The role of the Chamber of Trade and Commerce of the RF in the development and support of arbitration proceedings was described by the Head of the section of arbitral bodies of the legal department of the Chamber of Trade and Commerce of the RF, Deputy Chairman of the Chamber’s arbitration tribunal for commercial disputes and Merited Lawyer of the RF, K.I. Devyatkin.

The work of the Congress comprised three sessions, with the participation of the Head of the Faculty of International, Private and Civil Law of the Moscow State Institute of International Relations (University) of the Ministry of Foreign Affairs of the RF, Deputy Chairman of the ICAC of the Chamber of Trade and Commerce of the RF A.A. Kostin, and the President of Arbitration Tribunals of St. Petersburg, Armavir, Vladivostok, Tatarstan, Novosibirsk and others, A.S. Komarov.

The sessions examined the following themes: “The development, settlement and increase of the network of arbitral institutions in contemporary global practice”, “The legal nature of an arbitral agreement, the rules of arbitration tribunal proceedings, decisions of arbitration tribunals. The practical significance of theoretical concepts” and “Improving legislation on matters concerning the disputing of the rulings of arbitration tribunals and the issue of writs for the enforced execution of arbitration tribunal awards.”

A resolution was adopted on the outcome of the work of the Congress.

Yuri Alexeyevich TIMOKHOV, a partner of the law firm “YUST”, who is also an arbiter for commercial arbitration with the Moscow Chamber of Trade and Commerce and also with the Arbitration Tribunal of OJSC “Gazprom”, participated in the work of the Congress.
