Writ proceedings – changes the new chapter of the Arbitration Procedure Code will bring

On June 1st the Federal Law No. 47-ФЗ "On amendments to the Arbitration Procedure Code of the Russian Federation" came into force. It is to bring together the systems of general jurisdiction and arbitration courts through unification of procedural norms and mechanisms. Vladimir Boyarinov, senior lawyer of YUST Law Firm, told Pravo.ru portal about the influence of the law on practice: “Since June 1, 2016 the Arbitration procedure Code has a new chapter - "Writ proceedings”. As for the Civil Procedure Code, the most important addition concerning writ proceedings will be the condition that a court order will be issued only if the amount of money to be recovered or the value of movable property to be reclaimed does not exceed five thousand rubles. Therefore, the gap in procedural legislation that caused long-standing criticism of the court order mechanism will finally be filled".
