In its resolution, the operative part of which was declared on 13.11.2006, the Arbitration Court of the Moscow Circuit revoked the ruling of the Arbitration Court of the City of Moscow of 13.07.2006 and that of the Ninth Arbitration Appeals Court of 28.08.2006, pursuant to which the courts of the first and appeals instances dismissed the claim filed by LLC “Firma Iliev” for the acknowledgement as illegal the resolution of the Administration Rosnedvizhimost for the City of Moscow for the calling of the firm to book on charges envisaged by art. 7.1 of the Code for Administrative Violations of the RF (unauthorized occupation of a plot of land). Pursuant to the above-mentioned resolution of the Federal Arbitration Court of the Moscow Circuit satisfied the claim filed by LLC “Firma Iliev”, and the resolution of the Administration Rosnedvizhimost was revoked as contrary to the law.

The Federal Arbitration Court of the Moscow Circuit upheld the arguments of the legal representatives of LLC “Firma Iliev” – attorneys of the Law firm “YUST” – concerning the legality of the use of the disputed plot of land by LLC “Firma Iliev.”
