Gagarinsky shopping and entertainment center defended its name through court

Court proceedings between the daughter of the first astronaut in the world Yury Gagarin and the owners of Gagarinsky shopping mall, situated near Leninsky Prospekt metro station, entered a new stage. Today it became known that the Intellectual Property Court granted the application of Gagarinsky shopping and entertainment center LLC on reversal of the decision of Rospatent. Earlier, this document held invalid the decision on protection of the mall’s trademark.

Denis Shumsky, head of intellectual property group of YUST Law Firm, told Rossiyskaya Gazeta newspaper about the reasons of reversal of the previous decision of Rospatent: "The court found that the patent dispute chamber did not give proper consideration to a number of circumstances, which resulted in a false conclusion that the verbal element "Gagarinsky" cannot in itself indicate a specific historical personality. As a result, the courts did not make a decision to cancel registration of the trademark in question, but ordered to Rospatent to reconsider the objection of E. Gagarina and give proper estimate of all arguments and evidence".
