Yury Bogomolov, an attorney with the Law firm “YUST”, took part in a seminar held on 4-6 April 2007 on the subject of “International standards of the protection of human rights and criminal legal procedure.”

At this seminar, organized by the Federal Chamber of Advocates of the RF, the Russian Academy of Advocacy, the Justice Department of the US Embassy and the Branch of the American Association of Advocates, the participants discussed the possibilities of applying the international standards of criminal legal procedure for defense within the framework of national criminal procedure. The experts at the seminar were advocates with experience in application to the European Court of Human Rights, participants in matters examined by the European Court and lecturers from Russian institutions of higher legal education.

Of practical interest were such issues as the application by Russian courts of the provisions of the Convention for the Protection of Human Rights and Fundamental Freedoms, the approach of the European Court to supervisory procedure, the detention of persons suspected of lawbreaking by law enforcement agencies without evidence of the documentary formulation of such detention, discussion (in fact – interrogation) held with the suspect without the recording of a protocol.

The experts at the seminar advised attorneys to take more recourse to the provisions of the Convention for the Protection of Human Rights and Fundamental Freedoms in their practice, and also the rulings of the European Court on human rights issues, brought down with regard to Russia and other countries.
