Advocate Artem Kukin, Partner of the Law Firm "YUST", and Vasiliy Raudin, Lawyer of the Firm, told RAPSI of the latest business and court practice in the sphere of bankruptcy. They paid special attention to gaps and inconsistencies in the legislation faced by business in 2013.

The author explains, how the Resolution by the Higher Court of Arbitration of Russia No. 16533/11 influenced the judicial practice on the matters of pledge of a leased object.

The author of the article explains in detail the current court practice on the cases of restoration of parent’s rights, including the matters of jurisdiction, the child’s right to express his opinion in such disputes, the role of guardianship and tutelage bodies etc.

The book “See you in court. 7 scenarios of conflict dismissals with the evaluation of the employer’s risks” was published under the auspices of the “Labour Disputes” magazine (“Aktion-Media” Publishing Group). An interview with Advocate Maxim Rovinskiy, Head of Tax and Customs Law Practice of the Law Firm "YUST", on how to receive interest for late repayment of taxes by a tax inspectorate, was published in “Novaya Buhgalteriya (New Accountability)” (No. 10, October of 2012).

An article by Dmitry Manuylov, Lawyer of the Tax and Customs Law Practice of the Law Firm "YUST", on the possibilities to exact from the tax inspectorate the interest for untimely repayment of excess amount of taxes or for excessively charged tax amount by the tax authority was published in the “Novaya Buhgalteriya (New Accountability)” (No. 10, October of 2012).

Gaps of the Russian bankruptcy legislation leave the creditors without protection from the ill-faith debtors, who withdraw their assets prior to the bankruptcy. Even when the procedure is already initiated, money flows to the affiliated creditors, and the courts take the simplest position, which is formally legal, but is against the very essence of the law. Advocate Artem Kukin, Doctor at Law, Partner of the Law Firm "YUST", told Prime Agency of Economic Information of these and other offences frequently committed in Russia in the course of bankruptcy as well as of the ways to fight them in an interview.
