Contradictions will be eliminated from the “anti-piracy” law

The Federal Law No.364-FZ “On amendments to the Federal Law “On information, information technologies and protection of information” and the Civil Procedural Code of the Russian Federation” was adopted on November 24 of 2014. It will enter into force on May 1st of 2015.

Currently, the Federal Law No. 149-FZ “On information, information technologies and protection of information” dated 27.07.2006 establishes the procedure of limitation of access to the information distributed with violations of the exclusive rights to films, including cinematic films and made-for-television films. After the Law No. 149-FZ was adopted, the legal community widely discussed the matter of expansion of the effect of said Law and of limitation of the breaches of the exclusive rights to other objects of copyright and neighboring rights.

Those in favor of the expansion of the “anti-piracy” law effect cites the not-completely-due shrinking of the sphere of prevention of illegal activities in the Internet as their main argument, which greatly limited the rights of the right-holders to other results of intellectual activity. The Federal Law No. 364-FZ “On amendments to the Federal Law “On information, information technologies and protection of information” and to the Civil Procedure Code of the Russian Federation” dated 24.11.2014, which will enter into force on May 1st of 2015, is aimed at the elimination of said contradiction and affects all objects of copyright and neighboring rights, which may be distributed in the information and telecommunication networks (except for photographs).
