"Bristol" went to Kontact

The large network of alcohol shops "Bristol", registered in Nizhniy Novgorod, protects the business reputation in the arbitration court. The company is looking for the author of the message in one of the publics "VKontakte ", who suggested that the sale of alcohol at night in one of the stores in Shatura near Moscow could become a catalyst for a perfect series of murder. The management of the social network claims that it does not collect passport data of users, and the profile of the author of the publication registered to another person.

Head of the Intellectual property group of the YUST Law Firm, Denis Shumskiy, told Kommersant that it would be very difficult for the claimant to prove the connection between the fact that the owner of the phone number registered the page and posted information on it. Therefore, in such cases, the law provides for the responsibility of the domain owner, the expert adds. "In this case, the owner of the domain is VKontakte, and if the court determines that the information is detrimental, then the social network will bear responsibility for this and will be obliged to remove the publication and pay compensation to the plaintiff On the other hand, VKontakte is also an information intermediary, and in this case the legislative norms are more flexible. Acting in this role, a social network can block the page and not be responsible for the published content, "- says Denis Shumskiy.
