Meeting of the Academic Council of the ISM RAS: Actual problems of protection of competition and the ways of their solution

Representatives of the Law firm «YUST» took part in the discussion of urgent problems of protection of competition in Russia and ways of their solution.
20 March 2014 was held the expanded session of the Academic Council of the Institute of state and law, Russian Academy of Sciences (ISM RAS), in which took part the head of the Federal Antimonopoly service (FAS) Igor Artemyev with the report on a theme «Actual problems of protection of competition in Russia and ways of their solution». The report was devoted to «the Fourth Antimonopoly package», as well as trends in the development of Antimonopoly legislation.
The event was also attended by the Director of the ISM Russian Academy of Sciences Andrey Lisitsyn-Svetlanov, head of the Department for the fight against cartels FAS of Russia Andrey Tenishev, chief editor of the magazine «Russian competition law and economy», head of the Analytical Department of the FAS of Russia Alexei Sushkevych, head of the FAS in the Moscow region Igor Bashmakov-Nikolaev, Deputy head of Legal Department of the FAS of Russia Sergey Maksimov, Deputy head of the Department for the fight against cartels Pavel Samolisov.
Igor Artemyev in the framework of the report noted that currently the FAS Russia attaches special importance to the disclosure of cartel agreements, and also pays close attention to the observance of Antimonopoly legislation by the authorities. In addition, the head of the FAS of Russia spoke about the amendments in the law under the Fourth Antimonopoly package».
Members of the Academic Council of the ISM RAS took an active part in the discussion of the stories of the Antimonopoly legislation, and also expressed their suggestions regarding the further reforming legislation.
Discussing actual problems of competitiveness, head of the Department for the fight against cartels FAS of Russia Andrey Tenishev expressed the opinion that the amendments to article 178 of the criminal code will allow to more effectively fight anti-competitive agreements.
Managing partner of the Law firm «YUST», Evgeny Zhilin, the discussions with representatives of the FAS of Russia touched upon the problem of filing of class actions to the economic entities that have violated the antitrust laws.
The head of antitrust law group of the Law firm «YUST» Radmila Nikitina drew attention to the fact that currently the system is in the recovery of damages resulting from violations of the Antimonopoly legislation, does not work because there is no methodology for calculation of damages. Igor Artemyev has proposed to consider the development of methods of calculation of damages resulting from violations of the Antimonopoly legislation in the framework of work of NP «support to the development of competition».
