In its resolution of 13 July 2006, the Presidium of the Moscow City Court revoked the decision of the Meschansky District Court of the City of Moscow of 2 June 2005, and the determination of the Civil Chamber of the Moscow City Court of 25 October 2005, that had earlier acknowledged as legal the refusal of an insurance company to pay compensation for a stolen car.

In its ruling of 03.07.2006, the Federal Arbitration Court of the Moscow Circuit upheld the decision of the Arbitration Court of the City of Moscow of 10.01.2006 and the ruling of the Ninth Arbitration Appeals Court of 20.03.2006, in accordance with which LLC “HUNTER-SK” (Republic of Moldova) was denied satisfaction of its claims against LLC “Gazkomplektimpex” (Russia) for recovery of the debt for supplied but unpaid for production, losses (in the form of real loss and loss of profit), and also for interest for the use of another party’s financial means.

The First All-Russian Congress of Arbitration Tribunals took place in the Congress center of the Chamber of Trade and Commerce of the Russian Federation on 15 June 2006. The Congress was organized by the Chamber of Trade and Commerce of Russia and the Russian Center for the Support of Arbitration Tribunal Proceedings. The law firm “YUST” was represented at the Congress by Yuri Alexeyevich TIMOKHOV, who is an arbiter for commercial arbitration with the Moscow Chamber of Trade and Commerce and also with the Arbitration Tribunal of OJSC “Gazprom”.

In its resolution of 19.05.2006, the Federal Arbitration Court of the Moscow Circuit upheld the decision of the Arbitration Court of the City of Moscow of 18.11.2005 and the resolution of the Ninth Arbitration Appeals Court of 03.02.2006, that acknowledged as invalid the Decision of the District Inspectorate of the Federal Tax Service of the Russian Federation on Largest Taxpayers № 2 of 13.09.2005 concerning the refusal to call the taxpayer to book on charges of having committed a violation of tax legislation.

A conference on the “Arbitral resolution of international commercial disputes in Russia: new horizons” took place on 17 April 2006 at the Chamber of Commerce and Industry of the Russian Federation. The conference was organized by the above-mentioned Chamber, the International Commercial Arbitration Court of the Chamber of Commerce and Industry of the RF, and the law school “Statut.” Yuri Alexeyevich TIMOKHOV, a partner of the law firm “YUST”, took part in this conference.

The Presidium of the Moscow City Court revoked the sentence handed down by the Cheremushki District Court and the cassational determination of the Moscow City Court, and ruled to reclassify the actions of A.V. Lishko and A.A. Vilkov from art. 162 of the Criminal Code of the RF, to art. 161 of the Code.

On 10 April 2006, the Arbitration Court of the Samara Region dismissed the claim filed by the Regional Prosecutor against OJSC “Aviakompaniya “Samara” calling for the acknowledgement of the agreement on the joining OJSC “Aviakompaniya “Aerovolga” with OJSC “Aviakompaniya “Samara” as invalid (void), and the application of the consequences of an invalid (void) transaction.

The Judicial Division on civil matters of the Supreme Court of the Russian Federation dismissed the cassational submission of the prosecutor of the Sakhalin Region against the decision of the Sakhalin Regional Court of 26.10.2005.

On 29 March 2006, attorneys of the Bar Association of the Moscow Region “Law firm “YUST” met with Judge Galina Alexeyevna Karpova, who chairs the court body on taxation disputes in the Arbitration Court of the City of Moscow. The meeting was organized by the Federal Chamber of Advocates of Russia as part of the Chamber’s program for raising the qualifications of Russian lawyers.

On 22 March 2006, the Arbitration Court of the City of Moscow dismissed the claim filed by a shareholder of OJSC “DAR” against OJSC “DAR” and LLC “Kopeyka Development” calling for the acknowledgement of a property purchase-sale agreement between those two companies as invalid.
