In this article Tatiana Lvova, an Attorney of the Moscow Region Bar Association “Law Firm “YUST” has addressed the practice of using paragraph 1, clause 5, article 1234 of the Civil Code of the Russian Federation, which concerns the issue of a suit being brought by a former holder of an exclusive right against the new holder in the event that the latter has committed a material breach of the Exclusive Right Alienation Agreement failing to pay a fee for the acquisition of the exclusive right to the result of intellectual property and means of individualizing, if this exclusive right has in fact been transferred to the transferee.
