An earnest dispute about toy rifles The Intellectual Rights Court of Russia began deciding the matter about who has the right to produce toys, clothes and headwear bearing the image of the legendary AK-47 automatic rifle. The representatives of the arms concern “Kalashnikov” requested the court to early terminate the legal protection of the trademark – an image of the rifle with the inscription "АК-47". According to the concern, the trademark is hardly ever used and generates no profits.

Advocate Denis Shumskiy, Head of the Intellectual Property Group of the Law Firm "YUST", shared the statistics with the readers of the Rossiyskaya Gazeta: "The disputes on early termination of legal protection of trademarks due to the lack of use are for now the largest group of disputes considered by the Intellectual Rights Court. For example, over the first six months of the current year this category was responsible for approx. 60 per cent of the cases considered by the Court".

It is highly probable that the court will order an expert’s study on the case.
