Attorneys at the Law Firm "YUST" successfully represented the Non-Governmental Pension Fund “Norilsk Nikel” in a dispute with CJSC RUSAL Global Management B.V. (the Netherlands) on protection of business reputation, adjudicated by the Moscow City Court of

CJSC RUSAL Global Management B.V. (the Netherlands) (hereinafter - RUSAL) filed a lawsuit to the Moscow City Court of Arbitration claiming to protect its business reputation by declaring as false and defaming the information published on the Internet website of the Non-Governmental Pension Fund “Norilsk Nikel” (hereinafter – “Norilsk Nikel”). RUSAL also demanded that the defendant be obliged to publish a disproof on its website’s main page and compensate for reputational damages.

The Court of Arbitration of the City of Moscow by its Ruling No. A40-100073/10-12-634, dated January 17, 2011, dismissed the claim of RUSAL.

The Court considered the claimant’s arguments as being contradictory to the actual circumstances of the case and to evidence presented by the defendant.

Having studied the evidence presented by the defendant, the Court found that the information published on the defendant’s website and contested by the claimant was true. The claimant failed to prove that the information was defaming.

Also, the Court agreed with the opinion of the representative of the defendant that the contested data by itself contained no information on facts and events related to the claimant’s business reputation.
