Russians without a surname will not be able to buy tickets online Last week the court in Kaliningrad made a very important decision: considering an inheritance claim, the court held that absence of a surname cannot be a ground for denial to issue identification documents. In other words, the court recognized the right of Russian citizens to live in the country without a surname.

Lawyer of inheritance and family law practice of YUST Law Firm Svetlana Burkanova gave her commentary on this unusual decision to Rossiyskaya Gazeta newspaper: ‘Actually, article 19 of the Civil Code provides that identification of a party to a civil transaction is based on their name, including the first name, surname and patronymic, except cases of national peculiarities of name giving. The subject matter of the case in Kaliningrad court was not challenging the birth record - the information in the relevant certificate, but the grounds for inheritance. Apparently, in the course of inheritance proceedings the court, based on the evidence provided by the party, accurately determined the applicant’s identity, his relation to the ancestor and, accordingly, his right to inherit. This decision was made by the court taking into account specific circumstances of the inheritance case, in order to immediately protect the successor’s property rights. The decision of the Kaliningrad court cannot be a judicial precedent in connection with article 19 of the Civil Code. The commentary of certain mass media on this decision saying that it legalizes the possibility of using only the first name and patronymic in civil transactions, do not have any legal grounds. Conclusions on the case heard in the Kaliningrad court may be made only after examining the contents of the judgment.”
