Confiscation of land plots in Moscow and the Moscow Region. What are the risks of the business?

The session of the Committee on legal support of business protection of the Managers’ Association of Russia took place at the Moscow International Business Center “Moskva-City”. Representatives of the Moscow Court of Private Arbitration, of the MIEL-Novostroyki Investment and Realtor Company, of Integra Developer Group, Russian law firms took part in the event. Specialists of the Law Firm "YUST", Senior Associate Alfiya Dausheva and Associate Ekaterina Motyvan, were invited to participate in the session.

The matter of risks of the business involved in the procedure of confiscation of land plots in Moscow and the Moscow Region was offered for discussion. The topicality of the subject is due to the enactment of the Federal Law No. 43-FZ dated05.04.2013 “On peculiarities of regulation of certain legal relations in connection with the attachment of territories to the city of federal significance Moscow and on amendments to certain legal acts of the Russian Federation”.

V.I.Resina, Assistant to Deputy of the State Duma of the Federal Assembly of the Russian Federation, Svetlana Bachurina, Professor of the Chair of project and program management of G.V.Plekhanov Russian Economic University, told the members of the event about the development of the legislative base for the branch, the problems and their solutions.

During the discussion, the experts exchanged opinions on:

• The problem of the investment attractiveness of the New Moscow territory in connection with the risk of land confiscation;
• The possible ways for the right holders to defend their rights in such cases;
• Managing developer projects;
• The procedure of compensation payments at confiscating land plots;
• Further development of city construction and land regulation.

The participants were also able to discuss the advantages and disadvantages of settlement of the disputes that arise in connection with investment projects in courts of private arbitration.

Suggestions on improvement of regulation of land and city construction relations are planned to be sent to the State Duma of the Federal Assembly of the Russian Federation after the event.
