Intellectual property: the myth of legal monopoly and its negative consequences

On September 24, 2020, within the framework of the LF Academy educational project, a round table "Intellectual property: the myth of legal monopoly and its negative consequences" was held. The event was held for practicing lawyers who, by the nature of their work, face issues of legal protection of intellectual rights and protection of competition in the field of intellectual property. During the round table, leading experts in the field of intellectual property law and antimonopoly legislation spoke about the origins of the concept of intellectual property as a "legal monopoly" in Russian law, assessed its negative consequences for Russian legislation and law enforcement practice, discussed various ways to overcome the current misconception and possible legislative innovations in this area.

Dmitriy Seregin, Adviser of the YUST Law firm, gave a speech entitled "A view of intellectual property as a competitive advantage in actual terms" and focused on the role of intellectual property in civil turnover and the economy. Dmitriy Seregin noted that the protection of competition and the protection of intellectual property should not be opposed to each other, since intellectual property serves to strengthen competition, not weaken it. Therefore, possible contradictions should be resolved based on what will be more cost – effective, which will bring greater benefits to the whole society-limiting the claims of the copyright holder or providing him with additional opportunities to realize his interest. The topic aroused great interest among the audience.
