Complaints to the instances of appeal and cassation: 25 dangerous mistakes

02.08.2012

The book “Complaints to the instances of appeal and cassation: 25 dangerous mistakes” has been published. Alexander Yevdokimov, Head of Judicial Arbitration Practice of the Law Firm "YUST", is of the co-authors. The book contains the results of the summary of defects encountered during the contesting of acts by courts of arbitration. Representatives of courts of arbitration and of large law companies are among the co-authors of the book.

An excerpt from the introduction by the editorial staff of “Arbitration Practice” magazine:

<…>

This is a moderate-sized digest of the results of the summary of the most common defects encountered during the contesting of acts by courts of arbitration. And the statistics raised by the Supreme Court of Arbitration of the Russian Federation show that, during the past year, an average of one complaint per five court acts issued by the first instance courts was filed; almost 100 thousand cassation requests were registered.

Obviously, every lawyer, whose duty it is to take part in arbitration cases, has at least once dealt with the necessity to appeal against the decisions or rulings by a court, and, probably, has made at least one mistake – in the calculation of time limits, in the list of enclosed documents, in the indication of addresses and figures.

Precisely 25 mistakes were selected by our authors – practicing lawyers from both sides of the fence: representatives of the parties to a case and judges.

Our book will help to avoid common mistakes or correct them in time by using the colleagues’ recommendations, to discover the opponent’s errors and to save time collecting and checking the documents.
