An earnest dispute about toy rifles

The Intellectual Rights Court of Russia began deciding the matter about who has the right to produce toys, clothes and headwear bearing the image of the legendary AK-47 automatic rifle. The representatives of the arms concern “Kalashnikov” requested the court to early terminate the legal protection of the trademark – an image of the rifle with the inscription "АК-47". According to the concern, the trademark is hardly ever used and generates no profits.

The Tax Practice of the Law Firm "YUST" continues publishing surveys of arbitration practice on tax disputes. The most interesting cases, on which determinations of the Supreme Court of Russia and resolutions of district courts have been passed between July 6 and July 10 of 2015, have been considered today: Synergy LLC, “N.S.Artemov “Komsomolets” Plant of Tambov” OJSC, Chelyabinsk Metallurgical Plant OJSC, as well as “Managing Company of Multifamily Housing of the Zavlozhsky district” OJSC.

The FSS suggests closing the access to the information on the owners of immovable property

State corporations are likely to receive a new name

Anna Kotova-Smolenskaya, Partner of the Law Firm "YUST", shared with the Kommersant newspaper her view on the Government’s decision to reorganize state corporations and state companies as a new type of non-commercial organizations – public law companies (PLCs).

The Government has recently published the amendments to the draft law “On public law companies” elaborated in 2013, which was supposed to, in the case of its adoption, improve the control over the state corporations. As the draft law got stuck in the State Duma, the organizational form of PLC was introduced in the Civil Code in September of 2014.

The payments on deposits in the Ukrainian banks not covered by compensation payments from the Depositors’ Protection Fund will soon start in Crimea

The DPF will also pay the compensation to the citizens with large deposits, from the contribution to the fund of the Crimean authorities. However, the money of the republic will not be spent: the Crimeans will receive the complete insurance from the proceeds from the sale of the nationalized assets of Igor Kolomoysky, a Ukrainian oligarch. Even though Igor Kolomoysky will repay all the remaining obligations of the Ukrainian banks to the Crimeans from his nationalized property, this does not lift the liability from the banks. The law says that the DPF does not simply compensate the deposits over 700 thousand roubles, but buys out the claim rights under those, so that such claims could be made to the Ukrainian banks later. However, hardly anything can be recovered from those banks in this case.
